These Terms of Service ("Terms") govern your use of the dminder application ("Application") developed by Ontometrics. By downloading, installing, or using the Application, you agree to be bound by these Terms.

1. Use of the Application

The Application is a vitamin D tracking tool that provides estimates of vitamin D production based on solar position, atmospheric data, and your personal profile. You may use the Application for personal, non-commercial purposes in accordance with these Terms.

2. Medical Disclaimer

The Application is for informational and educational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. All calculations, estimates, and recommendations are approximations based on scientific models and should not be relied upon as a substitute for professional medical advice.

Always consult a qualified healthcare provider before making decisions about sun exposure, vitamin D supplementation, or any health-related matter. If you have a medical condition or are taking medications that affect sun sensitivity, consult your doctor before using the Application to guide sun exposure.

3. Accuracy and Limitations

While the Application uses real satellite ozone data, validated solar position algorithms, and peer-reviewed vitamin D production models, all outputs are estimates. Actual vitamin D production and burn times vary based on factors the Application cannot measure, including but not limited to:

You are solely responsible for monitoring your own sun exposure and skin condition. The Application's burn time estimates include a safety margin but are not guarantees against sunburn or skin damage.

4. User Accounts and Data

The Application stores your personal profile data (age, skin type, weight, height) on your device. If you enable iCloud sync or Google Drive backup, your data is stored in your personal cloud account. Ontometrics does not have access to your personal data. See our Privacy Policy for details.

5. In-App Purchases and Subscriptions

The Application offers optional in-app purchases:

All purchases are processed through Apple's App Store or Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions in your device's account settings.

Core functionality — vitamin D calculations, burn time safety, session tracking, and risk assessment — is always free.

6. Intellectual Property

The Application, including its code, design, algorithms, and content, is the property of Ontometrics and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Application.

7. Third-Party Services

The Application integrates with third-party services including:

These services are governed by their own terms and privacy policies. Ontometrics is not responsible for the availability or accuracy of third-party data.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Ontometrics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to sunburn, skin damage, vitamin D deficiency, or any health-related outcomes arising from the use of or inability to use the Application.

The Application is provided "as is" and "as available" without warranties of any kind, either express or implied.

9. Termination

You may stop using the Application at any time by uninstalling it. We reserve the right to suspend or terminate access to the Application if these Terms are violated.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Application after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Virginia, United States, without regard to its conflict of law provisions.
